1. General terms and conditions
These General Terms and Conditions (hereinafter referred to as "GTC") govern the contractual relationship between the Tourismusverband Südburgenland as operator of the Burgenland-Trails (hereinafter referred to as "Burgenland-Trails") and its contractual partners (hereinafter referred to as "customer"). The GTC apply to all current and future contractual relationships with the Burgenland-Trails, especially those related to the purchase and use of tickets and services. The Trailsrules/Terms of Use of the Burgenland-Trails as well as the transport regulations of the shuttle bus operators apply. The customer is obliged to behave considerately on the Burgenland-Trails and according to the Trailrules and not to endanger his own physical safety as well as the physical safety of other persons. The instructions of Burgenland-Trails and their supervisors are to be followed without fail.
Burgenland-Trails has the right to exclude persons who are not in the physical condition necessary for the use, especially those who are impaired by alcohol and other addictive substances, from the use, without any claim for compensation for the fee.
2. Tickets for the use of the Burgenland-Trails
To use the offers of the Burgenland-Trails it is necessary to purchase tickets. The Burgenland-Trails offer includes the Head Trail, the Batthyány Trail, the Rechnitz Trail, the Esterházy Trail and the shuttle service. The Tourismusverband Südburgenland - Burgenland-Trails may unilaterally change the offered services, provided that the respective change is reasonable for the customer and objectively justified. The customer will be informed about such changes to the services.
2.1. General provisions on the purchase of tickets
All persons are entitled to purchase tickets (day tickets and annual passes).
Tickets of the Burgenland-Trails are not transferable. A subsequent change of the validity period of the tickets is excluded.
Ticket prices and their period of validity are based on the respective price lists of the Burgenland-Trails. For the purchase of reduced tickets (children, seniors) a valid photo ID must be carried without exception.
The customer is obligated to store the issued ticket in such a way that third parties do not have access to it, so that misuse, loss and theft are avoided.
The customer is entitled to use the offers of Burgenland-Trails according to the purchased service during the operating hours. The operating and opening hours are determined for each season by the Burgenland-Trails and are valid according to the notice board on site or according to the publications on the homepage.
The customer is obligated to show the ticket upon request by the Burgenland-Trails staff. If the purchase of the ticket came about through an online booking, the booking confirmation is sufficient as legitimation.
False information regarding personal data, especially dates of birth, falsification of documents and/or falsification of documents will result in the immediate withdrawal of the entitlement and the exclusion from transportation. Compensation claims of the customer are excluded in this case. In this case Burgenland-Trails is entitled to claim a manipulation fee of EUR 75 as well as the fee according to the tariff of the actual ticket value. Burgenland-Trails reserves the right to assert further claims for damages as well as criminal prosecution.
Any misuse of the ticket will result in its immediate withdrawal without compensation. In particular, misuse is considered to be the attempted transfer and use of the tickets by third parties.
2.2. Acquisition and withdrawal

b. Purchase of the ticket via online ticket purchase:
The customer selects the desired ticket in the Burgenland-Trails online store and places it in the shopping cart. The customer enters the relevant data in the webshop. The customer acknowledges that the order process is binding by pressing the button "BUY" and that a cancellation is not possible after that. After completion of the ordering process, the customer receives a summary of his order. To complete the booking process, the customer must pay the amount via Stripe Payment. After completion of the payment process, a booking confirmation will be displayed, this is considered as an entry ticket.
The customer acknowledges that the contracts concluded with the Tourismusverband Südburgenland - Burgenland-Trails via their webshop, in particular tickets, are contracts for "leisure services" in the sense of § 18 Abs 1 Z 10 FAGG. Therefore, the customer has no right of withdrawal when concluding contracts via distance selling (e-mail, internet, fax, telephone, etc.) if a certain time or period is contractually stipulated for the fulfillment of the contract.
If Burgenland-Trails is ready to perform and if the offered services are, in principle, available, the customer has no right of withdrawal due to bad weather, early departure of the customer, temporary or weather-related interruption or cessation of operations, blocking of individual routes, illness of the customer or other circumstances originating from the sphere of the customer. A refund of the ticket price is excluded in these cases.
2.3. Loss and theft
If the customer forgets the day ticket or the season ticket or the booking confirmation, Burgenland-Trails will not provide any compensation for this. There is no refund claim of the customer.
In case of loss or theft of day tickets, this is at the expense of the customer. The customer must purchase the desired service again.
In case of loss or theft of season tickets, the customer is obligated to report this immediately to the Burgenland-Trails staff in order to carry out an immediate block. The customer is further obliged to immediately make an official report of loss or theft. The issuance of a new user authorization will only take place upon presentation of the loss or theft notification.
2.4. Special provision for the refund for season tickets
If the customer has purchased a season ticket and is unable to use Burgenland-Trails services as a result of an accident or illness that results in a health impairment of at least six weeks, a proportional refund of the ticket price will be made for the duration of the health impairment.
However, a refund is excluded if the annual pass could be used by the customer for more than half of the validity period.
The customer is obliged to submit a medical certificate confirming the duration of the health impairment, otherwise there is no entitlement to a refund.
3. Offer and prices
The services offered in the online store, on the website, at the advance booking offices and in the business premises of the Tourismusverband Südburgenland - Burgenland-Trails do not represent legally binding offers, but merely an invitation to the viewer to submit an offer to conclude a contract.
All prices displayed in the online store, on the website and in the business premises are inclusive of the applicable sales tax.
4. Conclusion of contract via online store
Adding the service to the shopping cart and pressing the button "BUY" or "BOOK" represents a legally binding offer to conclude a contract. With the payment by the customer a contractual relationship between Burgenland-Trails and the customer is established. After completing the order process, the customer will receive a summary of his order. To complete the booking process the customer has to pay the amount via Stripe Payment.
The booking confirmation issued by Burgenland-Trails in connection with a photo ID serves as a coupon for the use of the booked service and must be presented by the customer upon request of the staff.
4.1. Conclusion of contract via business premises
The customer's declaration to an employee of the Tourismusverband Südburgenland - Burgenland-Trails or to the employees of an advance booking office that he/she wishes to make use of services constitutes a legally binding offer to conclude a contract.
A contractual relationship comes into being through payment.
4.2. Means of payment
The following payment method is available for the online store: Stripe Payment. For services purchased on site, only cash payment is available.
4.3. Non-Utilization, accident or illness of the customer
In case of non-use of the ticket on the booked date and absence without reason, no refund will be made to the customer. Non-use of the ticket as a result of weather conditions constitutes non-use without cause.
If the customer has a valid annual ticket and it is impossible for the customer to use the service as a result of an accident or illness, a pro rata refund of payments already made will be made. Refunds will be made only upon presentation of a medical certificate.
Refunds are made in all cases by issuing vouchers, provided that no weighty interests of the customer are opposed.
4.4. Withdrawal by the Burgenland-Trails
If weather conditions do not allow the performance of the booked service for safety reasons, Burgenland-Trails has the right to postpone or completely cancel the booked service.
5. Liability, damages and statute of limitations
Burgenland-Trails is only obligated to compensate damages in all cases that come into consideration in the case of intent or gross negligence. In case of slight negligence we are only liable for personal injuries. Burgenland-Trails is not liable for indirect damages, loss of profit, loss of interest, missed savings, consequential and financial damages as well as damages resulting from claims of third parties.
Each customer is responsible for the use of the shuttle service.
6. Severability clause
Should individual provisions of these terms and conditions be invalid or incomplete, this shall not affect the validity of the remaining provisions. The invalid or incomplete provision shall be replaced by a provision that comes as close as possible to the invalid or incomplete provision in economic terms.
